Appeals court allows new trial for Widmer

MIDDLETOWN, OH (FOX19) - The 12th District Court of Appeals ruled Thursday to allow Ryan Widmer to get a new trial.

Widmer is accused of murdering his wife, Sarah, in a bathtub in August of 2008.

A jury convicted Widmer of murder in April, but Warren County judge Neal Bronson ruled for a new trial based on juror misconduct.

Warren County prosecutor Rachel Hutzel issued an appeal with the 12th District Court of Appeals, but the court ruled Thursday to not grant that request.

"Huge victory," said Mark Godsey, Widmer's attorney, in an e-mail to FOX19.

Warren County assistant prosecutor Matt Nolan says his office will review the ruling before they decide whether or not to appeal to the Ohio Supreme Court.
