Widmer files motion for a new trial or an acquittal

WARREN COUNTY, OH (FOX19)-- Ryan Widmer, the man who was convicted of killing his wife has filed a motion for an acquittal or a new trial.

 The motion was filed Thursday and Attorney Charles Rittgers says that the prosecution advanced the theory on how Sarah Widmer died because no other theory was supported with the facts given in the case.

The Defense also says that the prosecution failed to rise above the level of reasonable doubt in the case based on the fact that there was no sign of struggle or damage to the walls and areas in the bathroom, now defensive wounds on Sarah or marks on Ryan, and no evidence that any wet clothing or towels were put into the dryer.

The motion also states that the experts' testimony for the prosecution never linked the theory as to how Ryan killed his wife.

The defense believes that the jury shifted its burden to the defense to show why Sarah drowned or lowered the burden of proof with the prosecution.

Ryan Widmer was found guilty in the murder of his wife Sarah on April 2. He was acquitted of Aggravated Murder.
