FALMOUTH, KY (FOX19) - The truck driver accused of killing a local commonwealth attorney appeared in court Tuesday for the first time.

Daniel Gabbard entered a plea of not guilty. He kept his head down most of the time.

Gabbard, 40, faces charges of murder, operating a motor vehicle while under the influence of drugs or alcohol, and operating a commercial vehicle while under the influence of alcohol or other controlled substance for an accident in Pendleton County that killed Doug Wright, 48.

Wright was the commonwealth attorney for Pendleton, Harrison, Robertson and Nicholas counties.

The case will go to the grand jury on Wednesday.

Gabbard continues to be held in the Boone County jail on a $750,000 bond. His attorney, Eric Deters, said the bond is too high and they plan to fight to lower it at a later time.

Deters says if the case ends up going to trial, he'll push to have it moved out of Pendleton County.

Boone County's commonwealth attorney, Linda Tally Smith, has been appointed special prosecutor in this case.

"Obviously, our family's devastated and mourning the loss of Doug Wright and this entire community. It's really overwhelming," said Adrian Gabbard, the brother of Daniel.
