Prosecutor not requesting hearing for new trial

LEBANON, OH (FOX19) - Warren County prosecutor Rachel Hutzel says she is not requesting a hearing for a new trial in the Ryan Widmer case.

Judge Neal Bronson ruled Tuesday that he would consider a hearing if either prosecutors or defense attorneys so requested.

A jury found Widmer guilty of murdering his wife, Sarah, in the couple's bathtub. He is serving a 15 years to life sentence.

Bronson said Tuesday that jurors' alleged experiments on how long it took to air-dry after showering are influences that could have impacted Widmer's right to confront witnesses.

Defense attorneys said Tuesday they won't request a hearing, either. They say they're optimistic that Widmer will get a new trial.

Both sides had been submitting motions and affidavits for several weeks saying why or why not Widmer should get the new trial.

Now, the decision is up to Judge Bronson. There is no timetable on when he will make a ruling.
