Prosecutors will not appeal; Widmer will get new trial

LEBANON, OH (FOX19) - Warren County Prosecutor Rachel Hutzel says she will not appeal a decision by the 12th District Court of Appeals, clearing the way for Ryan Widmer to get a new trial.

Widmer was convicted of murdering his wife, Sarah, but he was granted a new trial after a judge ruled there was juror misconduct.

Hutzel appealed the decision, but her appeal was denied earlier this month by the 12th District Court of Appeals. On Tuesday, Hutzel said she has decided that she will not appeal that decision to the Ohio Supreme Court because a ruling could take years, and she doesn't want to do that to Sarah Widmer's family.

A hearing will be held on Oct. 7 to determine a new trial date. Hutzel says she expects the new trial to begin in January, and she's confident in her case.

"You never want to say it's a slam dunk," said Hutzel. "But I know what our evidence was, I know how it played to the jury, obviously we had an opportunity to discuss it with one jury, so yeah I feel pretty good about the evidence that we have."

Hutzel says she won't file for a change of venue.

"I don't anticipate doing that at the present time, but if circumstances force me to do that, that's what I'll do," she said. "Our goal at this point is a fair trial, and I'll emphasize another fair trial."

Widmer was released from jail earlier this month after a judge lowered his bond.
