CINCINNATI, OH (FOX19) - Prosecutors in Hamilton County are asking that a 17-year-old girl involved in a fatal hit and run accident be tried as an adult.

The teen is accused of hitting and killing Dayshaan Ballew, 13, over the weekend in Evanston. Ballew's 7-year-old cousin was also struck, but not seriously hurt.

During a juvenile court hearing on Wednesday morning, the 17-year-old entered the courtroom crying and holding a tissue. A judge set a hearing to determine whether or not the teen will be tried as an adult for October 8.

The teen was arrested Tuesday morning on charges of vehicular homicide, driving without a license and leaving the scene of an accident. She also faces a violation of a juvenile protection order because she had been under the care of the Department of Youth Services.

If convicted of the charges, she could spend five years behind bars. She is currently being held in the Hamilton County Juvenile Detention Center without bond.

Dayshaan Ballew's family was not in court Wednesday, but did tell FOX19 that they would also like to see the teen tried as an adult.
