Probable cause found in fatal hit and run

CINCINNATI, OH (FOX19) - A Hamilton County juvenile court judge determined that there is probable cause against a 17-year-old girl accused of fatally hitting and killing a 13-year-old boy.

The teen girl is accused of hitting Dayshaan Ballew with her car last month in Evanston.

A bind over hearing is set for Nov. 4 to determine whether or not the girl will be tried as an adult.

She is accused of driving without a license and told the judge that her passenger was holding her at gunpoint, telling her to drive. However, police say they do not believe that story.

The pair was caught on surveillance video at a Speedway gas station just before the incident. The girl said her passenger was driving up until the point when they stopped at the gas station, then she got behind the wheel.

Ballew's 7-year-old cousin was also hit, but not seriously hurt.

In addition, the girl is facing charges of aggravated vehicular homicide,  involuntary manslaughter, failure to stop after an accident and operating a motor vehicle without a valid operator's license.
