Allen told he court he was drinking and doing crack cocaine and marijuana before Ross's death. He told the court the baby had cried for much of the day.

"I just snapped, I lost control, of myself totally, you know," Allen told the jury."I jerked him by his leg and pulled him towards me. I picked him up and shook him and when I shook him I dropped him. I picked him up real quick, and his eyes were rolling in the back of his head, and I knew, I knew something was wrong."

Allen was the boyfriend of the baby's mother.
