LAWRENCEBURG, IN (FOX19)  A Lawrenceburg man is in jail accused of sneaking into a woman's house while she slept and then assaulting her.

Dwayne Lee Winters, 45, faces charges including Burglary, Strangulation, Sexual Battery, Interference with Reporting a Crime, Criminal Confinement, Criminal Trespass and Domestic Battery.

According to a court affidavit, Lawrenceburg Police were called to a home on the 200 block of Charlotte Street on Jan. 5 in reference to a battery that had occurred earlier in the day.

The female victim told officers that she was sleeping when she was awoken by Winters standing next to her bed. He then allegedly attacked the woman by suffocating her with a pillow before she was able to fight him off. Winters allegedly took the victim's cell phone as he ran so she could not call for help.

The victim, who had a prior relationship with Winters, had an order issued in 2008 that prohibited Winters from entering her residence.

Winters is currently held in the Dearborn County Law Enforcement Center. As of Wednesday morning his bond amount was under advisement.
