HAMILTON, OH (FOX19) - Rashon Martin, 18, will be released from jail after Judge Keith Spaeth dismissed his complicity to murder charge in the case of 15-year-old Amber Robinson who was stabbed to death in September. Spaeth cited insufficient evidence.

Khrendon Gray is charged with murder for the fatal stabbing.

Several peers of Amber Robinson took the stand Tuesday, saying they were there at the North Pointe Townhomes the night Robinson was stabbed to death.
The prosecution's first witnesses testified she heard Gray threaten to kill Amber Robinson that night. Raheem Davis testified he was also there, and identified who he saw stab Amber.
"Mr. Davis in this statement did you identify who stabbed Amber Robinson?" questioned the prosecution.
"Yes... Khrendon," Davis said.
Lamont Williams testified he saw a boy who looked like Khrendon Gray stab Amber.
"He walked up, he swung his arm like this, then I saw Amber fall and stumble to the ground and at that point I knew she had been stabbed," Williams said.
Khrendon Gray's girlfriend at the time, Ascia Wilson, testified to receiving a text message from Gray the night of the stabbing, it read "Baby I know this might sound crazy, I need you to talk to me, I'm about to leave Cincinnati."
While many witnesses could link Gray to the crime, none could connect Martin.
"During this time did he, did Rashon have a knife?,"questioned the defense.
"No I never seen him with a knife," Wilson said.
"Did you ever see him give anybody anything?"
"No," Wilson said.
