BATAVIA (F0X 19)-- A Duke Energy driver remains in jail after being arrested May 9 on drinking and driving charges in connection with a car crash.

Kenneth Mathers, 59, was arrested and charged with OVI (refusal) and driving left of center after a crash injured three people near 358 Foundry Avenue, off State Route 132 two weeks ago.

Mathers is scheduled to be in court Friday May 21 for a pre-trial hearing on those charges.

Batavia Police said the accident involved three vehicles: a Duke Energy truck, a mini van and a passenger vehicle. There were five people in the mini van. Police said three of them were taken to the hospital. One of those victims was flown to University Hospital.
