What makes a public nuisance

CINCINNATI, OH (FOX19) -  Cincinnati's Assistant Police Chief James Whalen says there are two ways of dealing with troubled entertainment establishments, asking Council to object to their liquor license.

"Which would make it illegal to sell liquor there and two exercise state's public nuisance law and attempt to shut down as a public nuisance," said Whalen

It happened in the case with Perkins Lounge, they fit the criteria. 

"It was an array of trafficking, shooting, drugs locking of doors," he said. "The establishment was a chronic offender and in the case of Perkins lounge when it comes to public nuisance, it's all about location, location, location."

 Perkins Lounge is sandwiched between a residential community, disturbances here roll out into the neighborhood. The Ritz is on a commercial lot, surrounded by businesses that are closed when it's open.  So the police exercised the second option asking council to object to it's liquor license renewal.

The liquor license had community support in mind, and strong community showing supporting the Ritz, and urging Council to not object liquor license.

So council didn't object, and then a fatal shooting here a week later, so Councilman Charlie Winburn is recommending, if there is a homicide or shooting at any establishment with a liquor license..." City Council has to recommend your license be revoked."

With or without public support.
