HAMILTON, OH (FOX19) - A grand jury issued a direct indictment of a Franklin man charged with aggravated vehicular homicide and two counts of operating a vehicle while under the influence.
Police say Curtis Ward had a blood alcohol level of .13 when he hit and killed 23-year-old Stacy Moermond, a husband and father of two, last Saturday night. Moermond was hit after he had pulled off the side of the road and exited his vehicle on St. Rt. 63 because he had run out of gas.
Prosecutors say this was Ward's third OVI. Prior to the indictment Ward was released after his bond was reduced to $2,000.
"In order to protect the public, I presented the case to the Grand Jury so a Common Pleas Court can determine if this is the kind of individual we really want out on the streets," said Assistant Prosecutor Jason Phillabaum in a press release.
"He obviously continues to drink and drive and now he has killed someone."
Ward will be arraigned in Butler County Common Pleas Court on Wednesday.
