LEBANON, OH (FOX19) - Attorneys for Ryan Widmer have until the end of the day Wednesday to file a motion for acquittal following last month's mistrial.
Widmer was tried for killing his wife, Sarah, in the bathtub of the couple's home in August of 2008. Last month's trial was Widmer's second trial after a new trial was ordered for juror misconduct in the first trial. Jurors failed to reach a verdict in the second trial.
If Widmer's attorneys file a motion for acquittal and Judge Neal Bronson accepts it, the case is over. If he denies the motion, prosecutors can re-file charges and start the whole process over again.
But if the defense files the motion on Wednesday, prosecutors have until July 20 to respond.
