WARREN COUNTY, OH (FOX19) -- The defense for Ryan Widmer has been granted one more day to file a motion for acquittal.

Judge Neal Bronson has given the defense a one day continuance to file their motion and the new deadline is Thursday at 4:30pm.

Widmer was charged for the death of his wife, Sarah Widmer back in August on 2008. The first trial was thrown out because of jury misconduct.

Last month the second trial was declared a mistrial because of a hung jury.
