Ohio judge postpones interstate custody battle

DAYTON, Ohio (AP) - An Ohio judge has postponed the custody hearing of a biological father from Ohio who is fighting with a California woman who has been trying to adopt the child.

Montgomery County Juvenile Court Judge Nick Kuntz rescheduled the hearing for August 31, after attorneys failed to wrap up their arguments on Friday. Attorneys for both the biological father, Benjamin Mills, and the birth mother, Rena Jordan, said they're disappointed with the delay.

Forty-five-year-old Stacey Doss, who's been trying to adopt 2-year-old Vanessa, said the court is thinking about the best interest of the child. Doss, of Rancho Santa Margarita, Calif., was granted an emergency stay earlier this month for a court order that required the girl to be sent back to Ohio. The biological filed for custody in Ohio in 2008 before the adoption was finalized.
