LEBANON, OH (FOX19) - Ryan Widmer's defense attorneys filed a motion on Wednesday to fight the change of venue of Widmer's third trial.
Warren County prosecutors want Widmer's third trial to be moved because of extensive coverage and attention the case is getting from the media.
However, Widmer's attorneys think they can get a fair trial in Warren County, and accuse Warren County Prosecutor Rachel Hutzel of fueling media coverage.
Defense attorneys suggested a using a jury questionnaire, similar to one used in Widmer's second trial, that will include specific questions regarding exposure to pretrial publicity.
Widmer was convicted of killing his wife, Sarah, in his first trial, but that conviction was overturned due to juror misconduct. His second trial ended in a hung jury. Defense attorneys stated they got an impartial jury in the second trial, and believe it can be done for the third trial because prejudice cannot be presumed.
Judge Neal Bronson will make the decision, but a time frame has not been given.
Sarah Widmer died in August 2008 in the bathtub of her Hamilton Township home.
