Gag order still in place in Widmer case

LEBANON, OH (FOX19) - A Warren County judge has ruled that a gag order will continue in the Ryan Widmer case.

Widmer is facing a third trial in January for the death of his wife, Sarah. A conviction in his first trial was overturned for juror misconduct, and a second trial ended in a hung jury.

During a hearing on Wednesday, Judge Neal Bronson ordered a gag order to stay in place for counsel, witnesses, Bronson's court personnel and those speaking on behalf of the defendants.

An attorney for the Cincinnati Enquirer, Jack Griner, claims the gag order was improperly set in place by Judge Bronson.

Before a gag order can be enforced, a hearing must take place with both sets of attorneys, presenting their arguments for or against it.

"This gag order should really not stand another day because it was not properly put in place and whatever the merits are the status quo should be that there is no gag order and that there could be one imposed, perhaps next Wednesday, upon a proper evidentiary showing, but until that time the status quo should be that there is none," Griner said in a hearing earlier this month.

Widmer was present at Wednesday's hearing.
