Charges pending after driver causes crash that killed brother

CINCINNATI, OH (FOX19) -  One man is dead after a fatal accident early Sunday morning.

The accident happened around 5:30 a.m. at 920 Riverside Drive, near the Boathouse. Police say 30-year-old Harvey Powers lost control of the vehicle, went left of center and struck a tree, utility pole and a fence. The vehicle continued westbound, crossing the roadway again and ended up on the right side of the road.

Harvey Powers was taken to University Hospital where he is currently listen in stable condition with non-life threatening injuries.

Brandon Powers, 25, was the passenger and was announced dead at the scene. Police say Harvey and Brandon Powers were brothers.

Neither of the men had seatbelts on.

Police say the brothers had been out drinking earlier Saturday evening, and driving a truck that didn't belong to either of them.

"The vehicle was owned by a third brother who attempted to report the vehicle missing or stolen this morning," said Sgt. Bill Coombs with the Cincinnati Police Traffic Unit. "He knew that his brothers had the vehicle and he was concerned they had taken the vehicle but that report came in after the accident had already occurred."

This incident is still under investigation. Police say Harvey Powers is not cooperating.

Speed and alcohol were factors in this fatal accident. Charges against Harvey Powers are pending.
