Apartment complex found guilty of 43 code and zoning violations

FAIRFIELD, OH (FOX19) - A Fairfield judge fined the owners of the Heritage Glen Apartment Complex for code and zoning violations. Some residents say there are several problems with the complex, including maintenance.

"It's really frustrating, half the time they don't answer their phone, then on the voice mail they have an emergency number and when you call that, they don't answer that either," said Monique, a resident at the complex.

A Fairfield judge fined the property owners, Eastgate Village Ltd., $129,000 for code and zoning violations. It is the second round of fines for the complex. Previously a judge found the complex guilty of 13 violations.

"There are some issues with mold, there are some issues with the ceiling, there is some issues with mechanical systems, heating, and hot water heaters etc.," said Tim Bachman with the Fairfield Building and Zoning Department.

A representative from Heritage Glen Apartments gave this statement:

"We are working diligently to satisfy all city building and zoning violations. At this time we have rectified multiple violations and several buildings have been approved for compliance by the Fairfield Building and Zoning Department."

Officials with the Fairfield Building and Zoning Department said several individual units have already been condemned and if necessary repairs aren't made, more drastic measures could be taken.

"It is certainly a possibility that we may be condemning entire buildings instead of entire units," said Bachman. "We will just have to see how they try to re mediate the problems that are over there."

A representative from the Heritage Glen Apartment community said they will have all violations rectified by its next court date of March 29, 2011.
