Defense attorneys file motion to delay Widmer's third trial

LEBANON, OH (FOX19) - Defense attorneys have filed a motion to delay Ryan Widmer's third trial by seven days.

Widmer is facing his third trial for killing his wife, Sarah, in 2008. Jury selection begins Tuesday.

Defense attorneys said in their motion that they wanted more time to review a statement from a mystery witness who prosecutors say will testify that Widmer confessed to killing his wife. They asked for a seven day continuance, which Judge Bronson denied. However, the jury selected Tuesday was not asked to be seated until next Monday.

Warren County Judge James Flannery ruled last week that prosecutors do not have to disclose the identity of the witness. Defense attorneys say they were not given seven days to review a statement from the witness, and without the opportunity to review that statement, they cannot effectively prepare.

A conviction in Widmer's first trial was overturned due to juror misconduct, and a second trial ended in a hung jury.
