Tricia's Middle Name Contest Rules


1. How to Enter the Contest: 

a. The "Tricia Macke's Million Dollar Middle Name" contest will begin on 1/31/11 at 10am EST. and end on 2/14/11 at 10am EST.

b. To participate in the contest, register for a chance to win at To register for a chance to participate, fill out the entry form by entering your home address, email address, cellular service question and guessing Tricia Macke's middle name. FOX19 will randomly select one (1) person who has correctly guessed Tricia's middle name as a finalist, and that person will have "a chance" to win the Grand Prize as further explained in rule #4 below.

c. Limit one (1) entry per person. Entrants may be disqualified at the sole discretion of FOX19.


2. Eligibility Restrictions: 

a. The contest is open to all FOX19 Viewers who are 18 years of age or older and who reside in the FOX19 viewing area, which consist of the following counties: Ohio: Hamilton, Cleremont, Brown, Adams, Highland, Clinton, Waren, Buter, Preble, Montgomery, Greene, Middletown. Kentucky: Gallatin, Boone, Kenton, Campbell, Owen, Grant, Pendleton, Bracken, Robertson, Mason, Harrison, Carroll, Scott. Indiana: Jefferson, Jennings, Ripley, Decatur, Franklin, Fayette, Union, Dearborn, Ohio, Switzerland, Wayne. Cincinnati Bell and Odds On Promotions ("OOP"), their respective affiliated companies, subsidiaries, distributors, dealers, retailers, printers, advertising, promotion agencies, agents, successors and assigns, any and all other companies associated with this contest, and the members of the immediate families or households of any of the above are not eligible. Immediate family shall include spouse, parents, children, siblings, grandparents, grandchildren and any other person residing within the same household.

b. Viewers are eligible to win a FOX19 contest only once every thirty days, which includes this contest.


3. Prize: 

a. Grand Prize: USD One million Dollars ($1,000,000), payable in an annuity over 40 years. A maximum of one (1) Grand Prize will be awarded. If the one (1) available Grand Prize is won in accordance with these Rules, the contest will officially end at the time the Grand Prize is won. If the finalist does not successfully select three (3) winning contest envelopes from a randomly commingled group of twenty (20) contest envelopes provided by OOP in accordance with these Rules, no Grand Prize will be awarded. 

b. The Grand Prize or consolation winner must pick up his/her prize at the office of WXIX, at 19 Broadcast Plaza 635 W. 7th St. Cincinnati, OH 45203. Any prize not claimed within forty-five days of winning will be forfeited by the winner. 

c. Contest prize is not transferable. 

d. The Grand Prize or consolation winner will receive 1099 IRS Tax form for the value of the prize as stated in these contest rules. 

e. Prize is limited solely to those item(s) explicitly set forth herein and shall not include any and all other expenses, incidentals or taxes that may arise out of the winner's receipt of this prize.

f. The Grand Prize is being provided courtesy of Hole In One International/Odds On Promotion, who may provide the Grand Prize to the Grand Prize winner, if there is one, in an annuity funded in one of the following ways:

(i) Yearly installments made payable to the Grand Prize winner equal to the prize value divided by the length of the annuity contracted (i.e. $1,000,000 prize/40-year annuity = $25,000.00 per year installments for 40 years).

(ii) Purchase a single premium deferred annuity, from an A.M. Best rated "B" or better Legal Reserve Life Insurance Company, with annual installments equal to the prize value divided by the length of the annuity contracted for. The selection of said company will be at the sole discretion of Hole In One International/Odds On Promotions.

(iii) Purchase any other investment grade funding vehicle or financial instrument, which shall be sufficient to meet the obligations described herein. The selection of said instruments will be at the sole discretion of Hole In One International/Odds On Promotions.

Grand Prize winner shall not sell, transfer, encumber, assign, or otherwise dispose of all or any portion of the prize annuity without the written consent of Hole In One International/Odds On Promotions in its sole and absolute discretion. Notwithstanding the foregoing, the Grand Prize winner's rights to payment shall be transferable to his or her heirs upon death. Hole In One International/Odds On Promotions' payment obligations with respect to the prize annuity exist only as to the Grand Prize winner and his or her heirs upon death and not to any other third party.

The Grand Prize winner, if there is one, releases and holds Sponsors, Raycom Media, Inc. and their affiliated companies, harmless from any actions, claims or liability if OOP, a life insurance company, the funding vehicle or financial instrument, as selected by OOP, fails to pay any annual payments to such Grand Prize winner.


4. Selection and Notification of Winners: 

a. Decisions of FOX19 management with respect to the contest are final.

b. A total of one (1) finalist will be randomly selected from all eligible entries received to participate in the contest and who correctly guessed Tricia Macke's middle name on his/her entry. A selected finalist that cannot be reached or contacted to confirm their selection does not meet the eligibility requirements, or does not wish to participate in the Grand Prize contest, will be disqualified. An alternate finalist will be randomly selected if time permits. 

c. In order for a Grand Prize to be awarded, the finalist must successfully select three (3) winning contest envelopes containing dollar amount symbols that total exactly One Thousand Nine Hundred Dollars ($1,900) from a randomly commingled group of twenty (20) contest envelopes provided by OOP.

d. A maximum of three (3) contest envelopes may be opened. Opening any additional contest envelopes or a master envelope corresponding to a prize level with a potential claim will cause the finalist to be ineligible for the Grand Prize or the consolation prize. 

e. The envelope pick must occur in the presence of the contest administrator. It may be videotaped and/or televised by WXIX. Any envelope pick attempt not in the presence of the contest administrator is not eligible for a Grand Prize, regardless of the outcome.

f. The odds of being selected as the finalist are dependent upon the number of entries received. The odds of winning the contest once selected as an official finalist are: 1:1,140.

g. If the finalist does not win the Grand Prize, he/she will receive the total dollar amount of the three (3) envelopes he/she selected as a consolation prize.


5. Conditions: 

a. Payment of all federal, state and local taxes are the sole responsibility of the winner, including but not limited to income taxes. Winner will be required to sign an IRS Form W-9 or the equivalent. Failure or refusal to execute the W-9, a release/affidavit of eligibility and any documents required by OOP will result in winner forfeiting the prize. Photo identification and social security number of the winner will also be required in order to collect the prize.

b. By participating in the contest, the finalist agrees to have his/her name, voice, or likeness used in any advertising or broadcasting material relating to this contest without additional financial or other compensation by the Sponsors and/or OOP, and to sign a release prior to acceptance of the prize.

c. A maximum (1) Grand Prize(s) will be awarded. The winner must accept delivery of prize from WXIX. All other costs related to prize delivery and acceptance is the responsibility of winner including but not limited to all federal state and local taxes. Prize is non-transferable. Sponsors reserve the right to substitute a prize of equal or greater value.

d. The winner will be required to complete and return a W-9 form (if prize value exceeds $600.00), affidavit of eligibility, and liability/publicity release , and present a valid photo ID and social security card before prize will be awarded. Winner will be issued a 1099 form reflecting the value of the prize and is responsible for paying all income taxes on the prize. Pursuant to the liability release, the winner will agree to release and hold Odds On Promotions, FOX19, its licensee, Cincinnati Bell, and the affiliated companies and the officers, shareholders, directors, employees, agents and representatives of each of them, harmless against any and all claims or liability arising directly or indirectly from the prize or participation in the contest. 

e. FOX19 reserves the right in its sole discretion to modify the contest rules and dates at any time for any reason. Material modifications shall be announced on-line at, when practical. By participating in this contest, you agree to be bound by these contest rules, any modifications thereof, and by all other rules imposed by FOX19 management. See for a copy of these contest rules, and for any updates or announcements concerning the contest. 

f. No purchase is necessary. Purchase does not increase chances of winning. The contest is void where prohibited. 

g. Failure to comply with the contest rules may result in an entrant's disqualification, at the sole discretion of FOX19. 

h. Sponsors and OOP are not responsible for typographical or other errors in the printing, the offering or the administration of the contest or in the announcement of a prize. 

i. Copies of the written contest rules and name of winner are available during regular business hours at the main studio of FOX19, 635 W. 7th St. Cincinnati, OH or by sending a self-addressed stamped envelope to FOX19.

j. Entries must be filled out completely and legibly in order to qualify, and will be void if they are, in whole or in part, incomplete, illegible, damaged, irregular, counterfeit, altered, or obtained through theft or fraud. No mechanically reproduced, software-generated or other automated multiple entries are permitted. Sponsors are not responsible for lost, late, illegible, misdirected or mutilated entries, including due to transmission, technical, and/or network failures of any kind, including, without limitation, malfunctioning of any hardware or software (whether originating with sender or Sponsors), telephonic failures, human error, or any other error or malfunction. For online entries, the authorized account holder of the e-mail address submitted at time of entry will be considered the entrant. An "authorized account holder" shall mean the natural person assigned to such e-mail account by the Internet access provider, online service provider, or other organization responsible for assigning e-mail addresses for the domain associated with such e-mail account. The finalist may be requested to provide proof that he or she is the authorized account holder of the e-mail address associated with a winning entry.

k. Entrants agree not to upload, post or transmit any materials which contain any computer viruses, Easter eggs, worms, Trojan Horses or other harmful component or programming routines that are intended to damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information. Any attempt to deliberately damage any website or undermine the operation of this contest is a violation of criminal and civil laws, and Sponsors reserve the right to seek damages from any person who makes such attempt(s).

l. Entry materials that have been tampered with or altered are void. Any questions regarding the number of entries submitted by an individual or the authorized account holder of an e-mail address shall be determined by WXIX in its sole discretion, and WXIX reserves the right to disqualify any entries by persons determined to be tampering with or abusing any aspect of this contest.

m. By entering this contest, entrant agrees that WXIX and the other sponsor of this contest may provide entrant with promotional materials and that WXIX may release entrant's personally identifiable registration information to the other sponsor for that purpose. WXIX is not responsible for the use of entrant's personally identifiable information by the other sponsor.

n. WXIX further reserves the right, in its sole discretion, to cancel or terminate this contest if, for any reason, it is not capable of completion as planned (including, but not limited to, for the following reasons: infection by computer virus, technical corruption, force majeure, or non-authorized human intervention that compromises or affects the administration, human error, fairness, integrity, security, or proper conduct of this contest).

o. The sponsors of this contest are WXIX, located at 635 W. 7th St., Cincinnati, OH and Cincinnati Bell, located at 221 East Fourth Street 103-1600, Cincinnati, OH (collectively, the "Sponsors").
