No charges will be filed in 4-year-old's shooting death

FRANKLIN COUNTY, IN (FOX19) - Franklin County Prosecutor Mel Wilhem says he will not pursue charges against the family of Aiden Mehlbauer, the 4-year-old boy who was accidentally shot and killed last week.

Aiden, 4, was shot in the abdomen Wednesday night at his home with a gun that he and his twin brother found in the basement. He died later that evening at Children's Hospital.

Aiden's father is a Franklin County Sheriff's Deputy. The gun was found in a closet where he keeps his police equipment.

Prosecutors say they reviewed Indiana State Police reports and spoke with investigators, and found the circumstances surrounding Aiden's death do not meet the elements of a crime under Indiana code.

Funeral services for Aiden Mehlbauer are being held Tuesday morning.
