Appeals court overturns former Miami student's conviction

The 12th District Court of Appeals has overturned a conviction for a former Miami University student who was accused of assaulting a classmate.
Yuyang David Bai was convicted of gross sexual imposition and assault on a police officer in March of 2010.
The Court of Appeals overturned the GSI conviction after it was found that the prosecutor and Bai's trial attorney committed errors during the trial. The conviction for assault on a police officer was upheld.
In its decision, the appellate court held that the prosecutor erred when he didn't provide a statement of the victim that gave specific details about the event in question. Bai's trial attorney erred when he didn't ask to see the victim's statement during his testimony so he could cross-examine her on the statement.
