MARTINSVILLE, Ind. (AP) - An Indiana prosecutor says he'll charge an 11-year-old boy in the shooting death of his 6-year-old brother.
WRTV reports Morgan County Prosecutor Steve Sonnega announced Friday that the boy would be charged as a juvenile with murder and criminal recklessness. WTHR says anyone over age 10 can be waived into adult court under Indiana law.
Sonnega says police initially thought the shooting was accidental. The Morgan County Sheriff's Department says 6-year-old Andrew Frye was shot in the head with a .22-caliber gun Thursday.
Emergency crews rushed to the home near Martinsville after the 11-year-old called 911 for help. Police say Andrew died a short time later after being taken by helicopter to an Indianapolis hospital.
A sheriff's officer says no adults were inside the home when the shooting occurred.
