CINCINNATI, OH (FOX19) - The Hamilton County Prosecutor's Office says charges have been dropped against a Silverton man who was accused of raping a 6-month-old baby and being HIV positive.
Silverton Police filed felonious assault and rape charges against Lenny Love, 29, after he told a relative and police that he raped the infant and was HIV positive.
The baby was examined at Children's Hospital for possible injuries consistent with Love's statement, but did not exhibit any injuries. In fact, prosecutors say nothing in the court clinic evaluation supported claims that the baby had been abused.
A physical examination of Love also revealed that he is not HIV positive.
Prosecutors asked the court for a mental evaluation of Love, which was granted. The Department of Job and Family Services has been notified about Love's statements and condition.
The Hamilton County Grand Jury ignored the charges on Friday, and both charges were dismissed.
"I am relieved that the baby is fine and that this incident was the fabrication of a mentally unstable person," said Prosecutor Joe Deters. "We always take these allegations seriously and must be absolutely positive that the incident did not occur."
