MASON, OH (FOX19) -

Last Friday a Warren County grand jury indicted John Anthony Foster for rape, sexual battery, and gross sexual imposition.

The 26-count indictment includes: 20 counts of rape, felonies of the 1st degree, of a victim under the age of 13; four counts of sexual battery, felonies of the 3rd degree; and two counts of gross sexual imposition, felonies of the 3rd degree. Two of the rape counts allegedly occurred by force. The indictment states all of the incidents occurred from 1999 to 2006.

Foster, a 36-year-old Mason resident, is the co-owner of the Primrose Academy in Maineville. The two alleged victims are acquaintances of Foster, but none are students at the private daycare and preschool.

The two forcible rape counts carry a maximum punishment of life in prison. The remaining 18 rape counts carry a maximum punishment of 10 years in prison for each offense. The maximum punishment for the six 3rd degree felony charges is 5 years in prison on each count.

Foster was originally charged with one count of rape in the Mason Municipal Court, which bound the case over to the grand jury after an August 4th preliminary hearing. Foster is being held in the Warren County Jail in lieu of $500,000 bond. Arraignment is scheduled for August 17th at 1:00 p.m. in the Warren County Common Pleas Court.
