Daycare owner sentenced to 30 years for rape of child

The daycare owner that originally pleaded not guilty on charges of rape, sexual battery, and gross sexual imposition, changed his plea to guilty on some of the charges and was sentenced to 30 years in prison.

John Anthony Foster was indicted in August on 26 counts. The 26-count indictment included: 20 counts of rape, felonies of the 1st degree, of a victim under the age of 13; four counts of sexual battery, felonies of the 3rd degree; and two counts of gross sexual imposition, felonies of the 3rd degree. Two of the rape counts allegedly occurred by force. The indictment stated all of the incidents occurred from 1999 to 2006.

Foster pleaded guilty to ten first-degree felony counts of rape with a victim under the age of 13. He will serve all 30 years in prison and is not eligible for parole. He will be labeled a Tier III sex offender when he is released from prison and he will have to submit to a DNA sample that will be entered into a national database for convicted sex offenders.

The remaining 16 charges were dismissed, including two forcible rape counts that carried a maximum punishment of life.

Foster still faces federal pornography charges in Cincinnati. A federal grand jury indicted him with 24 counts of receiving child pornography and one count of possession of child pornography last month. Each count of receipt of child pornography is punishable by up to 20 years in prison. Possession is punishable by up to 10 years in prison.

Foster has been given 89 days credit for time already spent in jail. He will have a mandatory probation for five years when he is released from prison. If he violates his probation, he will have to serve another year in prison.

Foster, a 36-year-old Mason resident, was the co-owner of the Primrose Academy in Maineville. The two victims are acquaintances of Foster, but were not students at the private daycare and preschool. The daycare has since closed.
