Blinking eye murder trial delayed

A murder trial in which a dying man's videotaped eye blinks will be used as testimony against the man accused of murdering him has been delayed.

Ricardo Woods' trial was scheduled to begin Monday in Hamilton.

A court official says the defense requested the delay. No new date was immediately set.

Woods is charged with murdering David Chandler in the West End in November of last year.

Police interviewed Chandler while he was paralyzed after being shot in the head and neck. Prosecutors say Chandler identified Woods' photo through a series of eye blinks. Chandler died about two weeks later.

The judge ruled earlier to allow jurors to see the video. Woods' attorney argued that the blinks weren't conclusive and should not be allowed in evidence.
