MIDDLETOWN, OH (FOX19) - Ryan Widmer's appeal of his 3rd trial will continue as his defense awaits a Warren County Judge's decision on a request for a 4th trial.
The 12th District Court of Appeals made the ruling after Widmer's attorneys filed a motion to stay the appeal. Widmer's attorneys wanted the Appeals Court to wait until Judge Neal Bronson decided on a new murder trial.
That motion was denied.
The defense says they have new evidence, including false statements in the record for the former lead detective in the case, Jeff Braley.
Widmer was sentenced to 15 years to life in February for drowning his wife Sarah in their Hamilton Township home in 2008.
