CINCINNATI, OH (FOX19) - A court hearing continues Wednesday over the Occupy Cincinnati arrests.
Attorneys representing those who were arrested in Piatt Park are asking the judge to dismiss the misdemeanor charges, arguing that park rules aren't laws.
The group is not only fighting to exercise first amendment rights, they are also fighting criminal trespassing charges.
Judge Dwayne Mallory is presiding over the hearing.
The prosecution is arguing against dismissing the charges first, followed by the defense's arguments in support of the motion. The hearing could take several days.
Members of Occupy Cincinnati demonstrated outside the courthouse during the hearing.
A decision on the motion could come at any time after the hearing, though Judge Mallory may wait to rule until the other justices rule on similar suits.
