Teen rape suspect ruled competent to stand trial

CINCINNATI, OH (FOX19) - A 13-year-old boy who is accused of raping a 5-year-old girl at a local McDonald's has been ruled competent to stand trial.

A juvenile court judge ordered the teen to undergo psychological testing during a hearing in November. The teen was back in court on Wednesday, and it was determined that he would stand trial.

A trial date was set for Jan. 4, 2012. The teen will remain in the Hamilton County Juvenile Detention Center until then.

Prosecutors say that the teen sexually assaulted the girl at the McDonald's on Beechmont Avenue on Oct. 29. The boy's parents turned him in after surveillance photos were released.

Due to his age, the teen will not be tried as an adult. Ohio law states that teens must be at least 14 years old for the court to consider trying them as an adult.
