INDEPENDENCE, KY (FOX19) -

A woman who is facing charges after her boyfriend was found dead was in court on Tuesday.

Emily Cox, 29, is charged with OVI and wanton endangerment. Police say Cox was arrested early Sunday morning after her boyfriend, Donald Setters, 33, was found dead.

Cox pled not guilty during her arraignment in Kenton County.

Setters was found just before 2 a.m. Christmas morning on Glenhurst Drive in Independence.

Police believe Setters hit his head when he was stepping out of the car Cox was driving. Police do not believe it is a suicide, and they also believe there is no evidence directly connecting Cox to his death.

Cox is facing wanton endangerment charges because police say she was driving drunk with her two children in the car.

The Independence Police Department is continuing to investigate the accident.
