Jimmy Dimora's forfeiture hearing has been continued until Wednesday morning.
Dimora was back in court Monday after being found guilty on all but one of the corruption charges filed against him on Friday.
His attorneys and federal prosecutors are going over proposed jury instructions regarding forfeiture. This is a second phase of the proceedings against Dimora.
In it, jurors must decide how much of Dimora's possessions can be taken from him at sentencing. Jurors are not present, but will return on Wednesday to hear arguments on what can be taken, this hearing was originally set for Tuesday.
The government's proposed instruction spells out what it believes can be taken. In short, it wants Dimora's house as a "facilitation forfeiture," meaning it was the base of operations for his criminal enterprise. It also wants the jury to decide how much money Dimora owes. This is known as a "proceeds forfeiture."
At trial, the government spelled out approximately $166,000 in bribes Dimora accepted. However, the statute also allows the government to take the value of any benefit those who bribed Dimora got.
His attorneys have filed objections to the government's assertions. Judge Sarah Lioi will arbitrate between the sides and make the final decision on what the jury will hear.
