Former Ben-Gal facing recent legal problems in case

Documents filed Friday by the prosecutor in the Ben-Gal cheerleader case contain evidence that could be damaging to Sarah Jones' case.

She's the ex-cheerleader and former Dixie Heights High School teacher who has been charged with engaging in sexual activities with one of her former students. At the time, he was a 17-year-old student.

One of the center issues in the case is text messages that, police and prosecutors say, were sent between Jones and the boy.

In the documents filed today there is one sentence that says, "Even the text messages themselves are wrought with Sarah Jones's commands to the victim to deny everything".

However, that can turn out to haunt the prosecutor, Sara Farmer.

"It could potentially show a guilty intent. If you're telling someone to deny everything, that's problematic and she'll have to explain that", said FOX19's Legal Analyst and former Hamilton County Prosecutor Mike Allen. "The filing of a document that has sealed information in it is problematic. The prosecutor should not have done that. The prosecutor's going to have to explain why she did that, why she filed that kind of document with the sealed information in it."

Jones' attorney Eric Deters reacted, "I mean there's nothing I can do. I can't un-ring the bell. The prosecutor in the Sarah Jones case published a text message in a pleading that she filed."

 He also thinks it's just one of many issues that will arise at trial. "This case's got all kinds of problems. There's a problem with the Grand Jury testimony. I mean the detective admitted in the Grand Jury testimony that it's all based on rumor. I mean it's a mess and it's a real mess now."
