LOUISVILLE, KY (WAVE) – Three of four men charged for the 2010 beating death of a man in a Crescent Hill restaurant parking lot have learned their sentences.

Two of the men, Donald Hays and Justin Werner, each were given five years probation. The third, David Pryor was given 12 months probation which was deemed already served.

Murder charges against the three were dropped to assault under extreme emotional disturbance. The change came because the Commonwealth could prove the victim, Bryan Stevenson, died from blunt force trauma, but not how that happened or from whom.

Stevenson, 26, of Maumee, OH, a Toledo suburb, was severely hurt early on the morning of May 30, 2010 in the altercation outside Barbara Lee's Kitchen in the 2400 block of Brownsboro Road. Stevenson was a 2005 graduate of Eastern Kentucky University and played baseball there. He was in Louisville taking part in a softball tournament.

A fourth person originally charged in Stevenson's death, William Schindler was found not to have been a part in the fight that happened that night. Schindler will be sentenced at a later date for minor drug charges that he received during his arrest.
