Gov. Bob Taft has signed a bill that asks the Ohio Supreme Court to require medical liability claims to include analysis on how the patient was harmed and how that harm resulted in injury or death. The expert would have to specialize in the same area of medicine as the defendant and be required to meet the legal requirement of an expert witness. The bill also makes any statement of apology, sympathy or compassion made by a health care provider to a victim or victim's relatives inadmissible as evidence as an admission of liability. The bill becomes law in 90 days.
