Driver charged with hitting, killing teen

The Hamilton County Prosecutor's Office has filed charges against a driver who is accused of hitting and killing a teenager while he was walking home from a party.

Adam Horvath, of Milford, is charged with vehicular manslaughter while committing a traffic violation for the death of Collin Barton, 16, on March 18. FOX19 Legal analyst Mike Allen and former Hamilton County Prosecutor says it's common for cases to be re-examined at the request of a victim's family.

"In a case like this I think the prosecutor said charges probably wouldn't be pressed. If new evidence comes along the prosecutor is completely in his rights to open the case and take another look at it," said Allen.  "It's unusual but it happens in every jurisdiction in this country."

Prosecutors say Horvath had fallen asleep and drove off the right side of the road and struck Barton, who was walking on an unpaved berm on Wooster Pike. Horvath stopped after the crash, but was unable to find what he had hit. He reported the incident to Milford Police.

Barton's body was discovered two days later in a wooded area in the 8600 block of Wooster Pike.

The vehicular manslaughter charge is a misdemeanor that carries a jail term of up to 90 days and a $750 fine, as well as a class 6 driver license suspension, which can extend from three months to two years.
