Lesbian couple asks appeals court to approve joint-parenting plan

A lesbian couple are asking a state appeals court to grant them both legal rights to their three-and-a-half-year-old son. Jennifer and Cheryl McKettrick want the Ohio 12th District Court of Appeals in Middletown to approve their shared-custody agreement for their boy, Joshua. Joshua was born from an egg donated by Cheryl McKettrick and carried by her partner. The couple's attorney, Heather Sawyer, says the Ohio Supreme Court in 2002 directed lower courts to look at the facts of a case and act in the best interest of the child.

Sawyer says a Warren County court erred last year when it rejected the custody agreement. The parenting plan would let either of the McKettricks make decisions about Joshua's medical care and sign legal forms on his behalf.
