A judge has ruled in favor of a Williamsburg family who is suing the State of Ohio over services provided to their son with Autism.
During a
due process hearing, Judge Michael Barrett ruled in favor of David and Holly Young, ordering the state to provide Applied Behavior Analysis Therapy
for their 2-year-old son. He will also
receive speech therapy provided by a state program.
The couple will be back in court on Tuesday for another due process hearing.
Their son, Roman, first began receiving care from the state in 2011. Holly Young says they stopped all treatment back in August and in December she and her husband filed a lawsuit in Federal Court. The family was arguing that the state is required by federal mandate to provide more extensive treatment called "Applied Behavioral Analysis".
The Ohio Department of Health claimed Applied Behavioral Analysis treatment is not a part of the Help Me Grow Program, an early intervention program.
