TOLEDO, OH (Toledo News Now) -

A Toledo man charged with raping a toddler was arraigned Monday morning, but not for the rape.

On April 24, police arrested Aubrey Dale Marshall, 55. He has been in jail ever since.

Court records show Marshall, who is already a convicted sex offender, did not register his address, which was a requirement after being convicted of unlawful sexual conduct with a minor back in 2003. Marshall faces felony charges for failing to register as a sex offender.

Police discovered Marshall moved two weeks after the most recent alleged rape occurred. However, since he did not have a lawyer, his arraignment was continued.

At his second court appearance April 25, Marshall was arraigned on two counts for rape of a victim under the age of 13, after allegedly raping a 2-year-old. The judge continued his bond of $2,050,000.

Marshall is due back in court May 7.
