Indictment: 12-year-old was neglected in 'especially heinous, atrocious, cruel' manner

MEMPHIS, TN -

(WMC-TV) – A certified nursing assistant, a father, and a mother have been indicted after the death of a 12-year-old Millington girl with special needs.

Andrea Ruth was 12 years old when she died on November 24, 2012. According to the Shelby County District Attorney's Office, Ruth suffered from asthma, hypertension and obesity, and had a "medically fragile state" which was allegedly ignored.

Prosecutors say that gangrene on her legs had gotten so bad that she was scheduled to have them both amputated in May 2011, but her family missed the appointment and subsequent follow ups. Prosecutors say at the time of her death, the girl's sores had advances to the point that they could see the bones in her toes.

Andrea's father, Errol Johnson, 42, was indicted on charges of first-degree murder in the perpetration of aggravated child neglect. He is locked up in Shelby County Jail without bond.

Certified nursing assistant and in-home nurse Chasara Jones, 41, was also indicted on charges of first-degree murder in the perpetration of aggravated child neglect. She is also locked up in the Shelby County Jail without bond.

Investigators say Chasara told them she knew about the child's condition but did not alert her employer, police, or Department of Children's Services.

"Anytime a child dies in our community, it's one too many," said Shelby County District Attorney Amy Weirich. "They're our most valuable and vulnerable resource and we all have a duty to keep them safe."

A Shelby County Grand Jury indicted the girl's mother, who has been arrested and is in custody in Louisiana.

"Not only do parents of course have a duty to take care of their children, every adult in the state of Tennessee has a duty under the law to report if you so much as suspect that a child is being physically or sexually abused," added Weirich.

The family had re-located to the Mid-South after Hurricane Katrina.

Action News 5 interviewed Errol Johnson, his wife, Raven Ruth, and their two children on April 17, 2006 to get their reaction to a New Orleans mayoral debate. The family went home to Louisiana to bury Andrea, but her father, Johnson, remained in Memphis.
