(FOX19) - The family of a teenager killed in an accident earlier this month has now filed a wrongful death lawsuit against the man they hold responsible for their son's death.
Damien Henderson, 16, died while a passenger in an SUV driven by Larry Molloy. Molloy crashed the car into a guard rail on I-275. Henderson was thrown from the vehicle. Police say he was not wearing a seat belt.
Investigators also say Molloy was under the influence of alcohol at the time. Police have yet to file formal charges against Molloy.
"You know, you just wish it would go quicker, but at the same time, I want them to take their time and make sure they do everything right," said Michael Henderson, Damien's father.
Damien's family filed a wrongful death lawsuit on Wednesday afternoon against Molloy. They say it is another way to hold him responsible for his role.
"He didn't deserve this. I'm trying to stay as strong as I can because somebody has to be the voice for that little boy and it has to be us, his family," said Damien's mother, Kimberly Johnson.
The family went on to say investigators plan to file criminal charges after a completed investigation sometime next week.
