Republicans on the House Oversight and Government Reform committee are alleging the IRS and Lois Lerner potentially broke the law by sending a database of tax exempt organizations to the FBI.

The database reportedly contained more than one million documents on tax exempt organizations. The Department of Justice says it should have never been sent to the FBI because it contained legally protected taxpayer information.

Lerner is the former head of the IRS tax exempt division and was ultimately in charge of the Cincinnati department accused of giving extra scrutiny to the Tea Party and other conservative groups who sought tax exempt status.

Lerner is being held in contempt of Congress for refusing to answer questions about the agency's targeting of conservative groups.

Republican lawmakers claimed on Monday the database was sent to the FBI weeks before the 2010 midterm elections. Democrats on the committee have not yet responded on the matter.
