Judge strikes down responsible bidder rules for sewer projects

A decision has been reached in the dispute between Cincinnati and Hamilton County as a judge struck down the "responsible bidder" rules.

The controversy is centered around the jointly-owned Metropolitan Sewer District.

The city and county were at odds over the responsible bidder rules and Cincinnati's mandated apprenticeship programs for MSD workers. 

The county opposed the rule, halting all projects in protest and it eventually lead to a court battle.

In response to the ruling, MSD issued this statement:

"MSD implements policy and the court ruling provides clarity on the procurement policy that will be implemented. However, MSD has used the city's procurement policy for nearly 50 years," the statement said.

"MSD is evaluating the county procurement policy, state law and developing a process for moving projects forward in compliance with the court ruling. Obviously, MSD is doing this expeditiously given the need to advance consent decree projects as swiftly as possible."
