Authorities have released surveillance video showing the last moments a Clermont County man spent in a bar before driving away and fatally striking a bicyclist in February.
The video from behind the bar of Ethel's Tavern shows Todd Shaw being served four beers and four mixed drinks over a three and a half hour period. The video also shows Shaw putting two bottles in his jacket and the bartender giving him a bag full of beer.
The Ohio Investigative Unit announced last week that the Union Township bar has been cited and a bartender charged with over-serving Shaw, the man sentenced to nine and a half years behind bars for the death of Fred Carey.
Shaw hit Carey, who was bicycling on Roundbottom Road, and then fled the scene. He was arrested the next day.
FOX19 NOW Legal Analyst Mike Allen says seeing the bartender give Shaw a bag of beer is troubling evidence.
"It looks like it's not your standard six pack," Allen said of the bottles the bartender gave Shaw. "It looks like some individual single beers thrown into a bag which I would think is of some questionable legality."
Shaw, who has seven previous drunk driving charges, is seen on security cameras walking out with his bag of beer and driving away from Ethel's. Moments later he struck and killed Carey.
Allen says anyone who serves alcohol has a tough job, and that this case should be a warning for them.
"They have to in some ways almost be a police officer in judging whether someone is intoxicated or not but it that decreased the number of deaths or serious bodily injuries, I think that is probably a good thing," Allen told FOX19.
FOX19 reached out to the owners of Ethel's Tavern for comment but did not receive a response.
