Tracie Hunter trial: Public Defender takes the stand

CINCINNATI (FOX19) -

Tracie Hunter has insisted she cannot receive a fair trial in Hamilton County, and she continued the fight Tuesday by asking again for the judge in her case to step down.

Hunter, who is charged with nine felony counts related to her position as a Hamilton County Juvenile Court judge, filed a motion with the clerk's office asking Judge Norbert Nadel to be recused from the case.

In the clerk filing, Hunter claims the court was biased in jury selection by allowing the state to strike all African Americans. The jury selection process took two days and was approved by Hunter's attorney Clyde Bennett before witnesses took the stand.

The suspended judge had previously requested to move the trial out of Hamilton County, stating the county could not hear a fair case because other Hamilton County judges would be testifying.. Judge Nadel dismissed those motions.

Hamilton County Public Defender Ray Faller was called to the stand Tuesday, the trial's seventh day.

Prosecutors questioned Faller over his lawsuit against Hunter in which he claimed the judge took too long ruling on numerous cases.

Faller said some of the 18 cases he sent to Hunter's juvenile court were delayed nearly one year, leaving his office and the juveniles in jail unaware of where the case was headed.

Hunter has pleaded not guilty to the nine felony charges, including tampering with evidence, theft and forgery. The charges carry up to 13 years in prison if convicted.
