Newport gym teacher accused of sex abuse appears in court

Eric Herald appeared in court Monday. Eric Herald appeared in court Monday.
NEWPORT, KY (FOX19) -

The Newport Intermediate School gym teacher accused of sexually abusing a student there is currently a free man, having already posted bond.

Eric Herald, 51, did not enter a plea Monday during his first court appearance since being indicted.

A week and a half ago, FOX19 Investigates uncovered that Herald had been disciplined before in another Kentucky school district.

The spokesperson for Boone County schools confirmed Herald resigned from Rector A. Jones Middle School in 2011 after he cut a lock of a female student's hair.

Newport Superintendent Kelly Middleton stressed his district was not aware of the prior incident, despite the fact that Boone County reported the disciplinary action to the state.

Most states require districts to publicly share discipline reports of teachers in an effort to keep problem teachers from leaving one school for another.

Newport Intermediate School fired Herald because of the allegations.

He is due in court again on Jan. 13 for a status hearing.
