The Supreme Court will be meeting behind closed doors Friday to talk about gay marriage.

The nine justices decided in October not to take up the issue of state bans on gay marriage.

The court has five cases pending including cases in Kentucky and Ohio.

The legal issue they are considering is whether the state bans violate the US constitution's guarantee of equal protection under the law.

The issue in Ohio and Kentucky stems from a November 6 decision by the U-S Circuit Court of Appeals in Cincinnati. That decision upholds marriage restrictions in Ohio, Tennessee, Michigan and Kentucky.

A separate case from Louisiana is also up for consideration.

If the Supreme Court decides to grant review of the cases, they could be scheduled for oral arguments, with a decision possibly coming by the summer.

Gay marriage is now legal in 36 states. The latest state to approve it was Florida.
