Fate of the estate belonging to a construction worker killed in the Hopple Street overpass collapse will be decided by a Bracken County Circuit Court.

Brandon Carl's fiancee, Kendra Blair, filed a motion to be named the mother of Carl's kids and listed as administrator of his estate. A judge granted Carl's parents control over the estate the day after his death.

Carl, 35, of Augusta, Kentucky, died Jan. 19 when the Hopple Street overpass collapsed as work crews prepared it for demolition. He left behind four children.

Blair, who shares children with Carl, challenged the Carl family's appointment in Bracken County District court. That court decided it had no jurisdiction over the case.

The Carl family have filed a lawsuit against the department of Transportation after officials from ODOT and the construction company involved in the demolition admitted an engineering flaw may have been to blame for the collapse.
